My frined got receipt from TSC yesterday, his attorney sent package them on 31st , I think they got it on June 1st. He has not got finger printing notice yet.
I applied on May 18th 140/485 Nebraska, Got receipt on May 28 from TSC with finger printing schedule after 2 weeks. 140 got approved on 23rd May.
Friends, My friends is saying if the New bill approves then we might have to re-apply again, even wealready have applied 485, is this True? I am bit confuse, I aksed to my Lawyer he said your Labor and 140 is New , he cannot tell anything at this point. If the person is already applied and waiting for Card should be effected, any opinion?

In current situation Labor is impossible for approval. My attorney told me clearly that labor is impossible to approve in this bad economy and wastage of money.

H1B is a non immigrant visa, and we dont have the full constitutional rights, for eq we dont have the right to vote.
Legally we are not immigrants, that is the worst mistake( calling ourselves immigrants) ,being done by us,
If USCIS denies GC for security reasons, you cant sue them.
voting is a privilege. minors, felons etc are not allowed to vote.
consitutional protections means basic protection to humans like due process, right to own property and so on.
some rights are overriden by immigration laws, like the freedom to choose employer.
but it is too late to worry about that.

I disagree a little bit - this will help people in EB3 indirectly
A lot of people in EB2 and EB3 can qualify for auto adjustment of status now, so it will remove people from EB3 queue making it smaller.

This method of collecting funds to get to a target and execute a pre-planned POA is great! I like this method, where we commit to funds and when we know, we have enough, we pull the trigger. But we need to have a plan and estimate the costs of that plan. This is a great way to go about, i think.

If you are consulting and not getting bench period salary, try to be out of project for some time and ask him to pay for that period. According to H1B he supposed to pay the salary. Probably at that point he has to let you go.

Per the 2005 Aytes memo (http://www.peludcarson.com/2007/01/aytes_memo_on_a.html) it is clearly stated that person can change jobs after 180 days irrespective of whether I-140 is approved or not. The key phrase is that I-140 should've been "approvable when filed".
So what? I-140 was "approvable" but now employer revokes it and therefore 485 denial becuase 180 days have not been passed. And that is why one never should even try to use AC21 before 180 days period. Even I-140 is already approved, revocation of it will initiate 485 denial.

Today I saw that my checks were cashed and I called USCIS to get the receipt numbers. The IO was very polite and gave me the numbers. Although I had filed at the Nebraska center, the receipt number starts with SRC (Texas).

For all those who are waiting...I would suggest one more thing, if your file is not touched. My lawyer had sent an email to NSC on Aug 2. I believe that along with my SR might have done the trick.....Sheela Murthy was my lawyer....that too might have helped....Who know what works....but we can all try.....Hope all who are stuck, get their GC by end of this month.

Yes...A thorough lawyer does this. I am very happy with my lawyer too. She was diligent and thorough...She sent a letter to TSC on the day our cases became current. She also attaches copies of CIS Memos (if applicable) when filing for extensions, reinstatements, etc. so that the IO does not raise RFEs indiscriminately...Once we got our GCs, she sent a long letter regarding Dos and Don'ts after getting Cards

My attorney told me it should be 1.5 months after the receipt date. But with this unprecedented volume, who knows...
